Terms and Conditions
The booking platform “booknowmed.com” (hereinafter: “Platform”) is provided by Virtus Vita Limited, a company duly established and existing under the laws of Cyprus, under registration number HE 305800 (hereinafter: “Virtus Vita”).
Virtus Vita reserves the right, at its sole discretion, to change these Terms and Conditions from time to time. Patient’s continued use of this Platform after such changes take effect will be deemed to constitute acceptance of new Terms and Conditions for Patients.
1. Description of Service
Virtus Vita is the organization offering Patients information about desired medical treatments and credentials about its medical affiliates (hereinafter: “Medical Facility”), as well as enabling a booking of a desired medical treatment. Bookings of the respective medical treatments are made by the Patients via the Platform.
2. Not A Medical Referral Service
Virtus Vita is not a medical referral service and does not endorse, recommend, or approve any Medical Facility listed in the Platform. Virtus Vita team is not composed of medical professionals and will not discuss or advise any issues relating to medical treatment.
Virtus Vita provides information about and facilitates contact with Medical Facilities with whom it cooperates and it provides information about their credentials in order for Patient to make informed decisions. Although Virtus Vita cooperates with Medical Facilities being certified and acknowledged medical care providers, it does not recommend any preferred or specific Medical Facilities and/or doctors for Patients’ desired medical treatment during their medical treatment.
Virtus Vita encourages and advises Patients to discuss all medical issues with their medical doctor at their country of domicile, before making a decision on traveling or undergoing a medical treatment.
Patients agree to assume all responsibility in connection with choosing any Medical Facility for their desired procedure either being a medical treatment or accompanying medical treatment during their holiday.
The medical treatment booked through the Platform by the Patient is subject to the agreement or any other arrangement between the Medical Facility and the patient.
Virtus Vita assumes no responsibility or liability for any treatment or other services rendered by any Medical Facility or by any Medical Facility’s staff, or for any malpractice claims and other claims that may arise directly or indirectly from any such advice, treatment or other services.
3. Eligibility, Using the Platform
Patient must be at least 18 years old and able to enter into legally binding contracts to access and use the Platform or register a Patient Account. By accessing or using the Platform, Patients represent and warrant that they are 18 years old or older and have the legal capacity and authority to enter into a contract.
Virtus Vita may access and/or make use of the Platform, or certain areas or features of the Platform, subject to certain conditions or requirements, such as completing a verification process, meeting specific quality or eligibility criteria, meeting ratings or reviews thresholds, or booking and cancelation history.
User verification on the Internet is difficult and Virtus Vita does not assume any responsibility for the confirmation of any Patient’s identity. Notwithstanding the above, for transparency and fraud prevention purposes, and as permitted by applicable laws, Virtus Vita may, but have no obligation to: (i) ask Patients to provide a form of government identification or other information or undertake additional checks designed to help verify the identities or backgrounds of Patients, (ii) screen Patients against third party databases or other sources and request reports from service providers, and (iii) where Virtus Vita has sufficient information to identify a Patient, obtain reports from public records of criminal convictions or sex offender registrations or an equivalent version of background or registered sex offender checks in your local jurisdiction (if available).
4. Account Registration
Patient must register an account (hereinafter: “Patient Account”) to access and use the booking feature of the Platform.
Patient can register a Patient Account using an email address and creating a password. Virtus Vita verifies the entered email address in the course of Patient Account registration.
Patient must provide accurate, current and complete information during the registration process and keep her/his Patient Account up-to-date at all times.
Patient may not register more than one (1) Patient Account. Patient may not assign or otherwise transfer his/her Patient Account to another party.
Patient is responsible for maintaining the confidentiality and security of her/his Patient Account credentials and if Patient discloses her/his credentials to any third party for conducting a booking on Patient’s behalf, she/he remains responsible for Patient Account credentials. Patient must immediately notify Virtus Vita if she/he knows or have any reason to suspect that her/his credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of her/his Patient Account. Patient is liable for any and all activities conducted through her/his Patient Account, unless such activities are not authorized by Patient and Patient is not otherwise negligent (such as failing to report the unauthorized use or loss of your credentials).
Virtus Vita enables Patients to (i) store their personal data and rate and review the Medical Facilities on the Platform (hereinafter: “Patient Content"); and (ii) access and view Patient Content and any content that Virtus Vita makes available on or through the Platform, including proprietary Virtus Vita content and any content licensed or authorized for use by or through Virtus Vita from a third party (hereinafter: "booknowmed.com Content").
The Platform, booknowmed.com Content and Patient Content may in its entirety or in part be protected by copyright, trademark international law, laws of Cyprus and other countries. Patient acknowledges and agrees that the Platform and booknowmed.com Content, including all associated intellectual property rights, are the exclusive property of Virtus Vita and/or its licensors or authorizing third-parties. Patient will not unauthorized use any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Platform, booknowmed.com Content or Patient Content. All trademarks, service marks, logos, trade names, and any other source identifiers of booknowmed.com used on or in connection with the Platform and booknowmed Content are trademarks or registered trademarks of Virtus Vita and its affiliates. Trademarks, service marks, logos, trade names and any other proprietary designations of third parties used on or in connection with the Platform, booknowmed.com Content and Patient Content, are used for identification purposes only and may be the property of their respective owners.
Unless Patient provides specific consent, Virtus Vita does not claim any ownership rights in any Patient Content and nothing in these Terms will be deemed to restrict any rights that Patient may have to use or exploit respective Patient Content.
Patient is solely responsible for all Patient Content it makes available on or through the Platform. Accordingly, Patient represents and warrants that Patient is the sole and exclusive owner of all Patient Content that she/he makes available on or through the Platform.
Patient will not store and post any Patient Content that: (i) is fraudulent, false, misleading (directly or by omission or failure to update information) or deceptive; (ii) is defamatory, libelous, obscene, pornographic, vulgar or offensive; (iii) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (iv) is violent or threatening or promotes violence or actions that are threatening to any other person; (v) promotes illegal or harmful activities or substances; or (vi) violates these Terms and Conditions or any other Virtus Vita policy. Virtus Vita may, without prior notice, remove or disable access to any Patient Content that it finds to be in violation of these Terms and Conditions or Virtus Vita’s then-current policies or standards, or otherwise may be harmful or objectionable to Virtus Vita, her/his affiliates, third parties, or property.
Virtus Vita respects copyright law and expects the Patients to do the same. If Patient believe that any content on the Platform infringes copyrights Patient own, please notify Virtus Vita.
6. Booking Procedure
Patient must be registered or signed in into her/his Patient Account and it must meet any requirements set by the Medical Facility (such as completing any verification processes) in order to complete the booking.
Patient may, after choosing a desired medical treatment, request its reservation or request a personalized quote for certain medical treatments. Patient receives a confirmation email after successfully submitting a reservation request or a request for a personalized quote.
As to the reservation inquiry for a desired travel arrangement or medical treatment, after the Patient receives the confirmation email, the relevant Medical Facility gets notified about the inquiry and is obliged to confirm or decline the reservation within 72 hours.
Only after the Medical Facility confirms the reservation inquiry, it becomes a booking and Patient gets a booking notification email. Accordingly, a legally binding agreement or any other arrangement is formed between Patient and the respective Medical Facility, subject to any additional terms and conditions of the Medical Facility that apply. The booking notification email contains the contact information of the Medical Facility in order for the Patient to get directly in touch with the Medical Facility and arrange all further matters. The confirmed booking is visible in the Patient Account. One week before the booking date, the Patient will receive a reminder email with all details of the booking.
If the Medical Facility rejects the reservation, the Patient gets notified by email.
The request for a personalized quote is managed by Virtus Vita via email and/or via telephone.
For good understanding, upon a Patient’s decision to seek healthcare services at the Medical Facility, the Patient shall provide all documents requested by the Medical Facility directly to the latter. Upon receiving the case file of a Patient, the Medical Facility shall review the same and respond to the Patient as soon as possible with a proposed course of action, treatment plan and a cost estimation. Upon the Patient’s consent, the Medical Facility shall coordinate directly with the Patient in order to arrange the completion of the agreed medical treatment. Virtus Vita is responsible of informing the Patient about the planned treatment through the Platform as per Medical Facility’s availability. Upon the Medical Facility’s request, the Patient will be solely responsible to communicate to the Medical Facility, by the agreed method of communication, any and all important information concerning agreed treatment, including, but not limited to the following:
a) The availability of the Patient;
b) Relevant medical reports of the Patient requested by the Medical Facility before treatment.
7. Booking Modifications, Cancelations and Refunds
Medical Facility and Patient are responsible for any modifications to a booking made via the Platform, and Patients agree to pay any applicable additional fees and/or taxes associated with such booking modifications directly to the Medical Facility.
Patients can cancel a reservation, request for personalized quote, or confirmed booking at any time and with no cancelation charges. Patients are not eligible for a refund, compensation or reimbursement of any kind from Virtus Vita, since they enter into an agreement with the Medical Facility.
No subscription fee to the Platform, nor any other fee is incurring to Patients, nor the booking of medical treatments via the Platform increases the medical treatment costs.
Virtus Vita does not collect any fees from the Patients for Platform usage, whatsoever.
Treatment costs which include necessary medical materials and medicines, taxes and charges are paid directly to the Medical Facility and are presented as total fees to Patient prior to conducting a booking via the Platform (hereinafter: “Total Fees”).
Patient agrees to pay the Total Fees to the respective Medical Facility for any confirmed booking in connection with Patient Account.
9. Necessary Documents
The Patient is responsible for being in possession of a valid passport during time of travel. Depending on length of visit, a Visa may be required for some or all of the countries visited. Patient is responsible to check the visa requirement for the particular destination country at the time of the booking.
Once the medical treatment is booked, the Medical Facility will inform the Patient about the necessary documents that they should bring with them and about any other prerequisite requested by the Medical Facility and the Patient is responsible for fulfilling these requests.
Patient is responsible for carrying with her/his EHIC card, if relevant for the booked medical treatment and for bringing any medicines and supplements they are taking which are not included with the booked medical treatment.
To the extent permissible pursuant to applicable law, Virtus Vita assumes no responsibility nor grant any warranties, express or implied relating to the operation, safety, condition or service of any physician, healthcare provider, hospital, aircraft, motor vehicle, boat, other conveyance, inn, lodge, or hotel and/or products associated with such entities or services that are used wholly or in part by, for or on behalf of the Patient. Virtus Vita is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such Medical Facility or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Virtus Vita does not provide any assistance nor covers any cost regarding aforementioned, whatsoever.
For good understanding, the Medical Facility shall use best efforts to rely upon the existing diagnostic tests and materials/reports of the Patient. However, if such test results are inconclusive or misleading, the Medical Facility shall have the right to request the Patient to undertake a fresh assessment in order to arrive at an accurate diagnosis prior to administering the most appropriate health care services to the Patient, subject to the completion of appropriate documentation by the Patient. Virtus Vita is not part of the direct “doctor-patient relationship” that is held between the Medical Facility and the Patient, and therefore shall not be held liable for requests regarding additional testing or fresh assessments that Medical Facility may or may not request the Patient to undertake.
11. Limitations of Liability
Patient agrees that neither Virtus Vita nor Medical Facilities will be liable for any damages resulting from Patient’s use of, or reliance upon, Platform, any materials, or any services obtained on or through this Platform. In the event of any problem with the Platform, any materials, or services obtained on or through this Platform, Patient agrees that her/his sole remedy is to cease using such items.
Patient agrees that under no circumstances will Virtus Vita be liable for any indirect, incidental, special, punitive, exemplary or consequential damages (including, but not limited to, lost profits and damages that result from inconvenience, delay, or loss of use) arising out of use of the Platform, any materials, arrangements made based on information obtained on or through the Platform, or products or services obtained on or through the Platform, even if Virtus Vita or its affiliates have been advised of the possibility of such damages.
Patient agrees to defend, indemnify, and hold harmless Virtus Vita and its affiliates from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs and expenses (including reasonable attorneys' fees and litigation expenses), relating to or arising from (i) Patient’s use of Platform, any Materials, or services obtained on or through Platform, (ii) any travel or other arrangements Patient make based on information obtained on or through Platform, or (iii) any breach by Patient of these Terms and Conditions.
13. Copyright and Ownership
All of the Platform materials, including the content and display of the Platform are the property of Virtus Vita. The Platform materials are protected by law, including, but not limited to, laws of Cyprus and international copyright law and trademark law and international laws and regulations. Other names and logos contained in Platform or in the Platform materials are trademarks and service marks of our affiliates and may not be used without the permission of the trademark or service mark owner.
14. Links to Other Sites
The Platform contains links to other sites on the Internet for the convenience of our users. These other sites are maintained by third parties over whom Virtus Vita exercise no control. Accordingly, Virtus Vita expressly disclaim any responsibility for the content of these other sites and for the availability, accuracy, reliability, completeness, currency, quality, performance or suitability of the information, products and services available or advertised on or through these other sites.
15. Suspension and other Measures
Virtus Vita may take the following measures:
- refuse to surface, delete or delay any reviews, or other content;
- cancel any pending or confirmed bookings;
- limit Patient’s access to or use of the Platform;
- temporarily or permanently revoke any special status associated with Patient Account; or
- temporarily or in case of severe or repeated offenses permanently suspend and/or deactivate Patient Account
in following circumstances: (i) in order to comply with applicable law, or the order or request of a court, law enforcement or other administrative agency or governmental body, (ii) if the Patient has breached these Terms and Conditions, Virtus Vita’s policies or standards, applicable laws, regulations, or third party rights, (iii) if the Patient has provided inaccurate, fraudulent, outdated or incomplete information during the Patient Account registration, listing process or thereafter, (iv) if the Patient has repeatedly received poor reviews or Virtus Vita otherwise becomes aware of or has received complaints about her/his conduct, (v) if Virtus Vita believes in good faith that such action is reasonably necessary to protect the personal safety or property of Virtus Vita, its affiliates, or third parties, or to prevent fraud or other illegal activity.
In case of non-material breaches and where appropriate, Patient will be given notice of any intended measure by Virtus Vita and an opportunity to resolve the issue to Virtus Vita’s reasonable satisfaction.
If Virtus Vita takes any of the measures described above, Patient will not be entitled to any compensation for pending or confirmed bookings that were cancelled.
Patient may terminate this agreement at any time via the “Delete Account” feature in her/his Patient Account or request deletion of her/his Patient Account by sending an email to: email@example.com.
Virtus Vita may delete Patient Account with immediate effect upon written notice if (i) Patient has materially breached her/his’ obligations under these Terms and Conditions and Virtus Vita policies, (ii) Patient has violated applicable laws, regulations or third-party rights, or (iii) Virtus Vita believes in good faith that such action is reasonably necessary to protect the personal safety or property of Virtus Vita, its affiliates, or third parties (for example in the case of fraudulent behavior of a Patient).
If the Patient or Virtus Vita terminates this agreement, the clauses of these Terms and Conditions that reasonably should survive will remain in effect.
17. Force Majeure
Neither party will be liable for any failure or delay in performing an obligation under these Terms and Conditions that is due to causes beyond her/his reasonable control, such as natural catastrophes, government acts or omissions, laws or regulations, labor strikes or difficulties, transportation, stoppages or slowdowns. If any of these causes continue to prevent or delay performance of obligations according to these Terms and Conditions for more than 90 days, the party not experiencing the delay may terminate the agreement, effective immediately, upon notice to the other party.
18. Applicable Law and Jurisdiction
Patient agrees that these Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Cyprus. Virtus Vita agrees that any legal action or proceeding under or with respect to these Terms and Conditions may be brought in the courts of the Republic of Cyprus having jurisdiction in Nicosia, Cyprus and for the purpose of any such legal action or proceeding, Patient hereby submits to the jurisdiction of such courts. Patient hereby agrees not to raise and waive any objection to or any defense based upon the venue of such courts and any objection or defense based upon an inconvenient form.
19. General Provisions
No joint venture, partnership, employment, or agency relationship exists between Virtus Vita and the Patient as a result of these Terms and Conditions or Patient’s use of the Platform.
These Terms and Conditions do not and are not intended to confer any rights or remedies upon any person other than the parties.
If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.
Virtus Vita’s failure to enforce any right or provision in these Terms and Conditions will not constitute a waiver of such right or provision unless acknowledged and agreed to by Virtus Vita in writing. Except as expressly set forth in these Terms and Conditions, the exercise by either party of any of her/his remedies under these Terms and Conditions will be without prejudice to her/his other remedies under these Terms and Conditions or otherwise permitted under law.
Patient may not assign, transfer or delegate this agreement and her/his rights and obligations under these Terms and Conditions. Patient’s right to terminate this agreement at any time remains unaffected.
Unless specified otherwise, any notices or other communications to Patients permitted or required under this agreement, will be in writing and given by Virtus Vita via email, Platform notification, or messaging service (including SMS and any online chat platforms).
